1: Contract

1.1: These terms and conditions cover the agreement for the supply of goods to ("you") the customer from ("we" and "us") HVW Ltd.

1.2: Acceptance of your order is subject to status and stock availability. Your order will be held electronically and in paper format by HVW Ltd for future reference.

1.3: You may cancel this aggreement at any time, up until the date of dispatch for your order, provided that your order is for non customised garments. Orders for customised garments can be cancelled up until the point that you have approved your printing/embroidery artwork. Once proofs have been signed off, cancellation isn't possible as the goods will then be customised leaving them in a non re-saleable condition.

2: Pricing

2.1: All prices shown in this online catalogue exclude post and packing and VAT, details of which are displayed on our "View Basket" page where you can view a final price before placing your order. Any applicable post and packing and VAT is payable by you in addition to the contract price. Every effort is made to ensure that the pricing on our website is kept up to date and accurate. It is possible that errors may occur leading to incorrectly priced items being listed on the site. In this rare event, you will be contacted by us before the order is accepted and notified of the issue. You then have the option to either accept the updated price or cancel the order.

3: Stock Availability

3.1: We cannot guarantee at the time of purchase that the items you order are always available. If you select a size/colour combination of a product that is out of stock, you will receive notification from HVW Ltd. At this point we will offer you alternative products which we feel will be suitable which you can accept or request a refund.

4: Product Images

4.1: We have made every effort to ensure that the colours and images used in this catalogue give a good representation of the products themselves, but we cannot guarantee this due to monitor resolution/brightness.

5: Delivery Schedule

5.1: HVW Ltd will not be liable for any consequential loss caused by failure of the carrier to deliver.

5.2: Any claim for non-delivery of or damage to the goods in transit should be made within seven days of the date of receipt for them. Our liability in respect of any such claim is limited at our option to replacement of the goods or refund of the price and does not extend to any indirect or consequential loss.

5.3: Orders above £200.00 before VAT will be dispatched free of charge. Below this value, a post and packing charge of £4.95 (plus VAT) per order will be incurred for deliveries within most areas of mainland UK. In the event that the carrier is unable to deliver to you and a second delivery journey is required, or if the second attempted delivery is unsuccessful, in which case the goods will be returned to HVW Ltd, additional carriage charges incurred may be charged to you. If your delivery address is not covered by our standard Postage service, you will be contacted by us to advise you of the additional cost involved in dispatching your order. The majority of mainland UK excluding the highlands, Isalnds, Channel Islands and Northern Ireland are covered by our standard service.

6: Returns Policy

6.1: Responsibility for the goods passes to you when they are delivered to the shipping address. Ownership of the goods remains with HVW Ltd until payment has been received in full for the goods and any other garments for which payment is also due.

6.2: If any garments are not required for any reason we will be happy to replace them or to refund their value provided that:

  • a. They are returned to us carriage paid, unused (other than for the purpose of trying on), within seven days of delivery.
  • b. Our invoice relating to the relevant goods has been paid by the due date;
  • c. A written note is enclosed quoting the invoice number and stating the reason for the garments being returned.
  • d. The goods have not been customised with a print or embroidery for you rendering them no longer re-saleable.

In the case of return of five or more garments a handling charge relating to the administration costs incurred may be applied by HVW Ltd. Goods returned are done so at your risk and you are advised to use a service which provides a guarantee of delivery. If you are returning items for an exchange, where the goods are not faulty, you will be responsible for carriage charges both ways. Please note that refunds issued are for the value of the goods returned only and not for the carriage charges.

6.3: Faulty garments (customised or non customised) can also be returned for exchange or refund. Carriage charges relating to the return of faulty garments will also be refunded providing that you have been in contact with us first to notify us of the impending return and, we agree that it is more cost effective for you to arrange the return shipment instead of us organising a collection.

7: Force Majeure

7.1: Where we are unable to perform due to any circumstances beyond our control we may suspend performance while those circumstances continue and any agreed date or period for delivery shall be regarded as extended accordingly. We will not be held liable for any consequential losses occurred due to circumstances beyond our control

8: General

8.1: This contract shall be governed by the laws of England and both parties shall submit to the non-exclusive jurisdiction of the English courts.
